Partition Deed

A partition deed is a registered legal instrument that divides jointly-owned property — typically held by HUF members, co-heirs, or co-purchasers — into exclusive, marketable shares for each party. Under Section 17(1)(b) of the Registration Act, 1908 it must be registered to be admissible as proof of title.

What is a Partition Deed?

A partition deed is a registered legal instrument that divides jointly-owned property among co-owners — most commonly Hindu Undivided Family (HUF) members, co-heirs after intestate succession, or co-purchasers — and grants each party an exclusive, marketable title to a defined share. It is governed by Section 17(1)(b) of the Registration Act, 1908, which makes registration mandatory for any partition of immovable property worth more than ₹100.

Without a registered partition deed, an oral or family-arrangement partition has limited evidentiary value and cannot be the basis for mutation, loan approval, or independent resale.

Why it matters for property buyers

If the seller acquired their share through partition, the partition deed is the root of their title. Skip verifying it and you risk:

  • Title challenges from excluded co-heirs — especially daughters, who acquired equal coparcenary rights retroactively under the Hindu Succession (Amendment) Act, 2005.
  • Mortgage rejection: banks need to trace the chain from the original owner through the partition before sanctioning a home loan.
  • Stamp duty defects: under-stamped partition deeds are inadmissible as evidence and need adjudication later, often at penalty rates of up to 10× the deficit.

How to verify or calculate it

  1. Get a certified copy from the Sub-Registrar where it was registered — Kaveri 2.0 in Karnataka, IGR Maharashtra, SRO in Tamil Nadu/Telangana. Cost: ₹100–₹500 plus ₹5 per page.
  2. Match the schedule of property in the deed against the survey number, khata, and boundaries in the current sale agreement. Any mismatch is a red flag.
  3. Check stamp duty. Under the Indian Stamp Act, partition deeds among family attract reduced stamp — Karnataka charges 1% (capped at ₹1,000 between family members); Maharashtra charges 2%; Tamil Nadu 1% of market value of the separated share (capped at ₹25,000).
  4. Run an Encumbrance Certificate (EC) for at least 30 years to confirm no later sale, mortgage, or competing partition has been recorded on the same parcel.
  5. Look for signatures of all co-owners or their legal heirs. Even one missing party can void the partition against that heir's share.
